Debt Recovery Lawyer Abu Dhabi — Recovering What You Are Owed
Abu Dhabi is one of the largest commercial centres in the Middle East. It is also a place where unpaid debts — from government contracts, oil-sector business, real estate, and everyday commercial dealings — are a regular reality. When someone owes you money in Abu Dhabi, the UAE court system gives you real tools to recover it.
Debt Recovery in Abu Dhabi — The Court System
Abu Dhabi has its own court system operating under the Abu Dhabi Judicial Department (ADJD). Civil and commercial cases are filed in the Abu Dhabi courts, which have jurisdiction over disputes arising in the emirate.
Abu Dhabi also includes two specialised judicial jurisdictions:
- ADGM Courts — the Abu Dhabi Global Market court system on Al Maryah Island, applying English common law. For entities and contracts within the ADGM financial free zone.
- Abu Dhabi Civil Court — for standard commercial and civil disputes across the emirate, including Al Ain and Al Dhafra.
We handle debt recovery in both the Abu Dhabi onshore courts and the ADGM Courts.
The Debt Recovery Process in Abu Dhabi
- Formal demand letter. Our first step is typically a formal legal demand notice sent to the debtor. A notice from a law firm creates urgency and establishes a legal record. Many debtors pay at this stage, particularly when they have Abu Dhabi business interests to protect.
- Filing in Abu Dhabi courts. If the demand is ignored, we file a civil claim in the appropriate court. For amounts under AED 500,000, there is a simplified process. For larger or disputed claims, the matter goes to the standard civil or commercial circuit.
- Precautionary attachment. Where there is risk the debtor may move assets or leave the country, we apply for an urgent court order to freeze the debtor’s Abu Dhabi or UAE-wide bank accounts pending judgment.
- Judgment and enforcement. Once judgment is obtained, we apply for enforcement through the execution court — salary attachment, bank account freeze, property block, and travel ban. An Abu Dhabi travel ban is valid across all UAE borders.
Bounced Cheques in Abu Dhabi
Cheque bounce cases in Abu Dhabi follow the same federal law as the rest of the UAE — Decree Law No. 14 of 2020. A dishonoured cheque issued on an Abu Dhabi bank account can be pursued both civilly (direct execution on the cheque) and criminally (complaint to Abu Dhabi Police). The criminal complaint is particularly effective as a pressure mechanism since most debtors settle quickly once police involvement begins.
Debt Recovery in Al Ain and Al Dhafra
Abu Dhabi emirate covers Al Ain and the Al Dhafra region (Western Region). Debt cases from these areas are filed in the relevant local courts — Al Ain Courts for the eastern region, and Al Dhafra Courts for the western region. Judgments from all Abu Dhabi courts are enforceable UAE-wide.
International Debt Recovery from Abu Dhabi
If the debtor has left the UAE, Abu Dhabi judgments can be enforced internationally in countries that have bilateral enforcement treaties with the UAE. The UAE has such treaties with a number of Arab countries. For debtors in countries without a treaty, enforcement is more complex but not impossible.
