RDC Execution Dubai — When You’ve Won the Case but the Tenant Still Won’t Comply
A surprising number of landlords reach us having already won their case at the Rental Dispute Settlement Centre — but still unable to get their property back or their money. The RDC issued an eviction order. The judgment says the tenant must pay. And yet the tenant is still in the apartment, not paying, and not responding to calls.
This is the execution stage — and it is where the real legal muscle gets applied.
What Is Execution in the Context of an RDC Judgment?
In the UAE court system, a judgment is a court decision. Execution is the process of enforcing that decision when the losing party does not comply voluntarily. The execution stage runs through the Dubai Courts Execution Department, separate from the RDSC itself.
To begin execution, you file an execution application with the court, attach your certified RDC judgment, and pay the execution fee. From there, the execution court has a range of enforcement tools it can deploy.
Execution Tools Available to Dubai Landlords
Bailiff-Attended Physical Eviction
The most direct tool. The execution court appoints a court-certified bailiff who attends the property on a scheduled date, with police assistance if needed. The bailiff serves the final enforcement notice, gives the tenant a final opportunity to vacate, and if they do not, oversees the physical removal of the tenant and their belongings. The locks are then changed under court authority. You cannot be present yourself during this process — the bailiff represents the court.
Salary Attachment
If the RDC judgment includes a money amount (unpaid rent, damages), the execution court can issue a salary attachment order to the tenant’s employer, directing them to deduct a percentage of the tenant’s monthly salary and pay it directly to you until the debt is settled. This is effective when the tenant is employed in the UAE.
Bank Account Freeze and Attachment
The execution court can order all UAE banks to search for accounts in the tenant’s name and freeze the balance up to the judgment amount. The frozen funds are then transferred to the court and paid to you. This is one of the faster collection methods.
Travel Ban
If the tenant has an outstanding money judgment against them and has not paid, the execution court can place a travel ban — preventing them from leaving the UAE until the debt is settled. Given that many expat residents in Dubai have reason to travel (family, employment), this creates significant pressure to settle quickly. A travel ban is often the first enforcement step we apply for, precisely because of its speed.
Property Seizure and Sale
In cases involving larger debts, the execution court can order the seizure and sale of the tenant’s physical assets (vehicles, furniture, business equipment) or, in some circumstances, register a block against property they own in the UAE. This is used less frequently in rental matters but is available for significant judgment amounts.
The Execution Process — Step by Step
- Obtain certified copies of the RDC judgment. You need an officially certified copy from the RDSC for the execution application.
- File the execution application at Dubai Courts. We prepare and file the application, including all required attachments. The execution fee is typically 1% of the judgment amount, subject to minimum and maximum caps.
- Execution court issues enforcement orders. Once the file is opened, the court issues the relevant orders — bailiff appointment, bank enquiry letters, travel ban application — depending on what enforcement we have requested.
- Enforcement actions are carried out. Banks respond to enquiry letters within days. The bailiff visit is scheduled (typically 2 to 4 weeks after filing). Travel bans are typically registered within a week.
- Settlement or full enforcement. In many cases, once the tenant receives the execution notice, they settle quickly — particularly if a travel ban is in place. If not, the physical enforcement proceeds.
