Trade Finance

Trade Finance Services in Dubai

Trade finance works on documents, not on goods. A bank pays against a compliant presentation whether or not the cargo ever arrived, and a trader who does not understand that distinction is exposed on every transaction.

Dubai Legal Expert advises traders, corporates and financial institutions across the UAE on trade finance instruments, documentation and the risks that attach to each structure.

What We Do

Instruments, Documents and Where Risk Sits

Documentary credits, standby credits, demand guarantees, documentary collections and open account arrangements each allocate risk differently between buyer, seller and bank. Choosing the wrong instrument for a transaction is a commercial decision with legal consequences.

Documentary credits in particular operate on strict compliance with the terms of the credit and the applicable rules. Documents that do not correspond exactly are discrepant, and a discrepant presentation can be refused regardless of whether the underlying performance was perfect.

Our Approach

How We Support Trade Finance

Alignment Check

Sale contract, credit terms and shipping documents aligned so a compliant presentation is actually possible.

Instrument Fit

The right structure for the counterparty and the risk, rather than whatever the bank proposed first.

Call Risk

Advice on demand guarantee exposure, since these can be called without proving underlying breach.

Shipping Documents

Bills of lading, insurance and inspection documents reviewed against the credit requirements.

Bank Engagement

Direct engagement with issuing and confirming banks on terms and presentation questions.

Fraud Awareness

Attention to the documentary fraud patterns that recur in regional trade transactions.

Why Us

Why Discrepancies Are the Main Commercial Risk

A significant proportion of first presentations under documentary credits contain discrepancies. Where the buyer relationship is good these are waived. Where the market has moved against the buyer, they become the mechanism for refusing payment on a perfectly performed contract.

The protection is upstream. Reviewing the credit terms before issue, and checking that every required document can realistically be produced in the exact form specified, prevents most discrepancies before they arise.

FAQ

Trade Finance FAQs

What is a documentary credit?

A bank undertaking to pay against presentation of documents complying strictly with the terms of the credit, independent of the underlying sale contract.

What is a discrepancy?

A document that does not comply exactly with the credit requirements. Discrepant presentations can be refused even where the underlying performance was correct.

What is a demand guarantee?

An undertaking payable on demand in accordance with its terms, generally without the beneficiary needing to prove underlying breach.

Which instrument should I use?

That depends on the counterparty, the market, the goods and the risk you are prepared to carry, and we advise on the fit for each transaction.

Can a bank refuse to pay?

A bank can refuse a discrepant presentation, and separate questions arise where fraud is alleged in the underlying transaction.

Should the credit terms be reviewed before issue?

Yes. Reviewing the terms before issue is the most effective way of preventing discrepancies later.
