Payment Mechanics
Dates, method, account and the consequence of a late payment, all defined rather than assumed.
A settlement agreement that records the amount but not the mechanics is how one dispute becomes two. When the payment is late, the release is ambiguous or the withdrawal of a complaint is not addressed, the parties end up back where they started.
Dubai Legal Expert drafts settlement agreements across the UAE, covering payment structure, default consequences, mutual release and, where appropriate, ratification before the court.
Beyond the amount, a workable settlement addresses when and how payment is made, what security supports it, what happens immediately on default, exactly which claims are released, and what each party must do procedurally to close the existing proceedings.
Where a criminal complaint is involved and the offence permits reconciliation, the agreement must also deal with the withdrawal of that complaint in the correct sequence relative to payment, which requires careful drafting on both sides.

Withdrawal of proceedings and complaints sequenced correctly against payment for both sides.
Court ratification where it strengthens the enforceability of the agreed terms.
Accepting payment over time is often the only realistic way to settle. Without an acceleration clause it is also a considerable risk, because the paying party can stop after the first instalment and the receiving party is left enforcing each missed payment separately.
An acceleration provision solves this. Default on any instalment makes the entire remaining balance immediately due, which both protects the receiving party and gives the paying party a strong incentive to maintain the schedule.
Agree the substance, then document the mechanics that make it hold.
We establish what is being settled, what claims exist on each side and what the realistic terms are.

A properly drafted agreement is enforceable as a contract, and court ratification where available strengthens the enforcement position further.
A provision making the entire remaining balance immediately due on default of any instalment, which is essential where payment is by instalments.
Notarisation strengthens the evidential position, and for certain instruments it also affects the enforcement route available.
For offences where reconciliation is permitted, yes, and the sequencing relative to payment must be drafted carefully for both parties.
Precisely which claims are settled and which survive, because ambiguity here is a frequent source of a second dispute.
