DIAC is the leading arbitration institution in Dubai. Under Dubai Decree No. 34 of 2021, the former DIFC-LCIA Arbitration Centre and the Emirates Maritime Arbitration Centre were abolished and their caseloads consolidated into DIAC, which now operates under the modern DIAC Arbitration Rules 2022. Onshore UAE arbitration is governed by Federal Law No. 6 of 2018. Key features include the tribunal’s power to rule on its own jurisdiction (competence-competence), party autonomy over procedure, recognition of electronic and multi-contract arbitration agreements, and the power to grant interim measures. The 2023 amendments (Decree-Law No. 15 of 2023) refined rules on arbitrator impartiality and their relationship with arbitral institutions, and clarified aspects of the conduct of proceedings.
It is essential to distinguish onshore arbitration (governed by the Federal Arbitration Law and supervised by the Dubai or Abu Dhabi Courts) from offshore arbitration seated in the DIFC or ADGM. The correct seat and supervisory court must be identified at the outset, because it determines how interim relief is obtained and how the award is ultimately enforced.
An arbitral award is only valuable if it can be enforced. Onshore, a party seeking to enforce a domestic award applies to the competent Court of Appeal for ratification and an order of enforcement under the Federal Arbitration Law. Foreign awards are enforced under the New York Convention 1958, to which the UAE is a party, and the UAE Civil Procedure regime. Grounds to refuse enforcement are narrow and largely limited to matters such as invalidity of the arbitration agreement, denial of due process, or conflict with UAE public policy.
We also act on the other side — challenging and setting aside awards or resisting enforcement where there are genuine procedural or jurisdictional defects. Time limits for annulment actions are short, so early advice is critical.
Most arbitration problems are avoidable at the contract stage. A well-drafted clause should clearly specify the institution and rules (for example DIAC 2022), the seat of arbitration, the number and method of appointing arbitrators, the language, and the governing law. Ambiguous or “pathological” clauses cause costly jurisdictional fights. Most commercial arbitrations take roughly 12 to 24 months from filing to a final award, depending on complexity, the number of arbitrators and whether there are jurisdictional challenges.
Parties can agree to arbitrate after a dispute arises by signing a submission agreement. Without an arbitration agreement, the dispute will normally be heard by the UAE courts.
